This book examines the legal questions that arise in the context of the medical treatment of transident and intersex minors. In the first part of the work, the medical-biological foundations of transidentity and intersexuality as well as the medical and social treatment of both phenomena are presented. This is followed by a discussion of the significance of gender in law and the treatment of transgender and intersexual persons in terms of personal status. In the following main part of the work, the general prerequisites of lawful medical action are first analysed and then applied to the special case groups of transidentity and intersexuality, whereby special attention is paid to the indication and consent by a minor himself or by the custodial parents. In addition, there is an in-depth analysis of § 1631e BGB. Finally, the legal treatment of both groups of cases is compared, taking into account the existing actual differences, and the question is discussed as to whether the current legal situation does justice to the respective specific concerns of both groups of cases.
